What are the specific requirements for Bundesnetzagentur approval

The Bundesnetzagentur (BNetzA) handles approvals for various network tariffs and infrastructure projects, each with specific requirements. Here's a breakdown:

Network Tariffs
* Gas Network Operators: For gas network operators that have not yet had a revenue cap set, tariffs are calculated cost-reflectively, requiring approval from the BNetzA[1]. This applies during a transitional period until the new regulatory period starts[1].
* New Gas Supply Systems: Operators of newly constructed gas supply systems that fall under the BNetzA's competence must apply for network access tariff approval in writing[1]. This application should be submitted at least six months before the tariffs are due to take effect[1].
* LNG Facilities: LNG facility operators also need tariff approval from the BNetzA, and they are subject to special rules[1].
* Required Documentation: Tariff applications must include all necessary documents for review and be submitted in writing or electronically[1]. Written applications should ideally be on single-sided A4 paper, signed, and sent by registered post, along with other documents required under section 23a(3) EnWG[1].

Frequency Assignments for Short-Term Use

* Application Submission: Applications should be submitted no later than 15 days before the planned start of use[4].
* Late Submissions: Timely assignment cannot be guaranteed if applications are submitted late. Also, assignment fees are higher for applications received less than 15 days before the first day of use[4].
* Grounds for Denial: The assignment may be denied if the requirements for efficient and interference-free use of frequencies are not satisfied[4]. Also, assignments may be denied if fees charged by the BNetzA have not been paid[4].

General Requirements

* The BNetzA is responsible for approvals under section 23a EnWG if the applicant operates a gas distribution system that crosses federal state borders or if at least 100,000 customers are directly or indirectly connected to the system, according to section 54(1) and (2) EnWG[1].
